Please review these Terms of Use carefully prior to using Cap & Carry. By registering, logging in, or navigating the platform, you agree to abide by these terms.

1. Acceptance of Terms

These Terms of Use (“Terms”) constitute a legally binding agreement between you (“Golfer”, “User”, or “You”) and Cap & Carry (“Cap & Carry”, “We”, “Us”, or “Our”). By accessing our web application, registering an account, utilizing GPS course yardages, logging rounds, or participating in community leaderboards, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

2. Platform Description & Scorecard Services

Cap & Carry is a web application built to record, share, and analyze golf performance. Features include hole-by-hole scorekeeping, club carry gapping, GPS course yardages, handicap calculation, and round collaboration. The service is provided for recreational and athletic self-improvement purposes.

Handicap Notice: Cap & Carry calculates a WHS-style index for your records. It does not post official scores to a national handicap body.

3. On-Course Physical Safety & Situational Awareness

GOLFER SAFETY IS YOUR PRIMARY RESPONSIBILITY:

Golf courses present inherent physical hazards including errant golf shots, moving motorized golf carts, water bodies, uneven terrain, and severe weather. When utilizing Cap & Carry on a mobile device:

Always prioritize real-world situational awareness. Do not stare at your device while walking near cart paths, crossing bridges, or while other players are hitting.
Severe Weather & Lightning: Immediately cease play and seek shelter whenever lightning, high winds, or severe storms approach. Never remain in an open area to interact with mobile scorecards during storm warnings.
Cap & Carry assumes zero liability for personal injury, property damage, or accidents occurring on golf courses or driving ranges.

4. GPS Accuracy & Course Yardages

Cap & Carry calculates distances using satellite GPS coordinates and digitized golf course geometry. While we strive for high precision:

GPS readings are subject to satellite atmospheric distortion, hardware limitations, cloud cover, tree canopies, and mobile browser geolocation accuracy.
Green pin positions may fluctuate daily depending on course management. Distances to front, center, and back of greens are calculated against geographic centroids and green boundary vertices, not physical daily flag placements.
Distance metrics are provided as assistive guidance. In tournament play, golfers are responsible for adhering to local governing rules (e.g. USGA / R&A Rule 4.3 regarding distance-measuring devices).

5. Golfer Accounts & Community Conduct

By registering an account with Cap & Carry, you agree to:

Maintain the confidentiality of your account authentication credentials.
Provide genuine information and refrain from impersonating other golfers.
Submit authentic scores and round data to maintain integrity across leaderboards and handicap calculations.
Refrain from abusive, harassing, defamatory, or unlawful conduct within community activity feeds, golfer profiles, or round comments.

6. Intellectual Property & Golfer Content

Your Content: You retain ownership of your submitted scorecards, notes, club data, and personal journals. By submitting content publicly, you grant Cap & Carry a non-exclusive license to store, process, and display that content according to your privacy settings.

Platform Property: The Cap & Carry brand, logo, vector artwork, software code, user interface designs, and typography are the exclusive intellectual property of Cap & Carry.

7. Limitation of Liability & Warranty Disclaimer

THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. CAP & CARRY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, COMPLETELY ERROR-FREE, OR ACCURATE TO MILLIMETER TOLERANCES. IN NO EVENT SHALL CAP & CARRY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APPLICATION.

8. Modifications & Termination

We reserve the right to modify these Terms at any time. When material adjustments occur, we will update the “Last Updated” date at the top of this document. We reserve the right to suspend or terminate accounts that breach these Terms or compromise platform security.
